APPLE has agreed to pay a fine of $2.25m to the Australian Consumer and Competition Commission (ACCC) for misleading consumers by advertising the iPad as 4G, The Australian reported.
The tech giant and consumer watchdog proposed the settlement agreement this morning, which a judge will pass final ruling on next week.
The fine follows a legal case brought by the ACCC last year after Apple claimed in its marketing that the New iPad was 4G capable, when it was only compatible with spectrums that were not available in Australia.
The New iPad works on 700MHz and 2100MHz bands - neither of which are available here.
Optus successfully tested 4G on the 700Mhz spectrum - which the Federal Government is due to auction off at the end of the year - but claimed it would not have access to it until 2015.
Telstra announced in October 2010 that they would be switching off its 2100MHz 3G networks by August this year, theoretically freeing it up for 4G. However, a Telstra spokesperson told news.com.au in March the telco planned to reuse the band in their Next G network.
On top of the $2.25m, Apple will also have to pay $300,000 to cover the ACCC's legal costs.
