Huawei has announced that the European Commission filed antitrust complaint against the U.S. company InterDigital, which calls on the Commission to stop the abuse by my InterDigital patents, supposedly necessary for standard 3G (UMTS).
As the applicant has not engaged in the production and marketing of products, InterDigital patents using its standard 3G Huawei to compel the conclusion of unequal and discriminatory licensing agreement. Requirements for InterDigital in its terms and content is clearly contrary to Article 102 of the "Treaty on the Functioning of the European Union", and also the policy of the European Institute of Telecommunications Standards, which encourages owners of patents on the technology to the formation of a fair non-discriminatory licensing practices (on the basis of FRAND).
Huawei in talks with InterDigital in order to reach an agreement on royalties payments for mobile devices. Given that to date it became obvious that the acceptance of this agreement in the foreseeable future is not expected, Huawei has decided to file a complaint with the European Commission.
